Your Booking Agreement with Ferreolus
Please read these
booking conditions carefully.
General Terms and Conditions
These terms and
conditions are applicable to all bookings made with Ferreolus
Catharcountry.info including reservations made via other members of the travel
community.
These terms and
conditions apply equally to all residents of any country around the world.
1. Prices and price changes
1.1 We can guarantee
the price of your booking in any major currency.
1.2 Students of 18
years plus enjoy a discount of 7.5%. The same terms and conditions apply. Student
identification required.
1.3 Group
discounts are available for scheduled and personalized tours.
1.4 It is
recommended that participants should be 14 years plus to participate in tours
of two or more days.
1.5 Scheduled
tours prices do not include snacks, bar bills, airport transfers or arrival in the
Languedoc.
1.6
Payments made by credit card or debit card are subject to a 1.2 percent processing charge.
2. Changes made to your Tour by us
2.1 Tours are
continually improved and changes may be made to the scheduled tours as
advertised. We reserve the right to alter at any time any place visited,
itinerary or hotel owing improvement to the tour or to unforeseen circumstances.
3. Personal
travel insurance.
3.1 No compensation
of any kind or responsibility can be taken if, due to circumstances beyond the
control of Ferreolus or the relevant service providers, we have to
notify a change to your arrangements or we or the relevant service providers
cannot supply your arrangements in full or in part as agreed, or you suffer any
loss or damage of any description. A circumstance beyond our (or the relevant
service providers’) control is one that cannot be foreseen or avoided, even
after taking all due care and includes but is not limited to war, terrorist
activity, civil unrest, industrial disputes and bad weather situations or
forecasts. Every endeavour will be made to advise participants in advance
of any alterations that are deemed necessary in the tour itinerary
provided. In the event of any passenger not being carried for any
cause whatsoever, no liability will be accepted by the operators. Should
the passenger fail to arrive or arrive late to a starting point or during the
tour, then no liability can be accepted.
3.2 It is a condition
of our contract with you that you and all members of your party have suitable
and sufficient travel insurance to cover your journey as neither Ferreolus nor
our suppliers can be held responsible for any liability, expenses or losses you
incur as a result of being inadequately insured. We strongly recommend that a
comprehensive travel insurance policy is purchased at the time of booking.
3.3 You are
responsible for your personal safety and for the safety of the accompanying
people dependent on you. Please take time to understand and then conform to the
health and safety rules stipulated by appropriate authorities. You agree
to defend and indemnify Ferreolus and suppliers and any of their officers,
directors, employees and agents from and against any claims, causes of action,
demands, recoveries, losses, damages, fines, penalties or other costs or
expenses of any kind or nature including but not limited to reasonable legal
and accounting fees, brought by:
• you or on your
behalf in excess of the liability described above; or
• by third parties as
a result of your breach of this agreement or the documents referenced herein or
your violation of any law or the rights of a third party.
4. If you have a complaint
4.1 If you have cause
for complaint whilst on your Tour please bring it to our immediate
attention. The health and safety standards that apply to the services you
have booked should meet the local standards If you have a concern
with any safety standards you come across, you must take this up with the
relevant service provider in the locality concerned at the time of your trip.
5. Payment
5.1 Payments may be
made by bank transfer, Paypal or credit card. Bank transfer details are
provided upon request.
5.2We accept most
credit cards but not American Express.
5.3 Ferreolus does
not charge a service fee for processing credit card payments.
Payment will be listed as “Ferreolus AS Duncan” on your credit card
statement.
5.4 Prices are per person,
unless otherwise specified. Prices include VAT and local taxes.
5.5 A non-refundable 25% of the
tour price is paid at the time of booking. The balance is settled
no later than two months before the start date of your tour.
5.6 Price
quotations are valid for 3 months and then subject to change without notice
until a booking has been confirmed but not once a booking has been confirmed.
6 Refund and compensation policy
6.1 In the event that
a venue is not visited due to unforeseen circumstances, an amount equal to the
value of the admission will be refunded in full.
6.2 When the full
tour price has been paid in advance 50% of the payment is refundable when
the client cancels two months or more from the beginning of the tour
date. Tours cancelled within two months from the start of the
reservation date are non-refundable. Participants are advised to procure
personal travel insurance in case of unexpected changes to their travel
arrangements.
7 Personal conduct
7.1 We reserve the
right to require any person from any tour, if we deem their actions or conduct
offencive, or a nuisance to other passengers, to leave the tour. As such, we
shall have no further liability
8 Luggage
8.1 Any items left in
vehicles are left at the owner`s risk. Ferreolus will not take responsibility
for loss or damage to those items.
9. Special Requests
9.1 Please inform us
at time of booking of any special requests for any service or facility that is
not included as part of your booking. We will enquire with the relevant service
provider and where possible will try to accommodate your request, but please
note such requests cannot be guaranteed.
9.2 Ferreolus will
normally take and may use photographs taken on
Cathar Country Tours. Exceptions can be agreed on request.
10. Our liability to you
10.1 Unless caused by
our own negligence we have no liability of any kind whatsoever to you or your
party or dependants for any death, personal injury, loss, consequential loss or
damage of any kind you or your party or your dependants may suffer.
Ferreolus its agents and suppliers also accept no responsibility or
liability whatsoever for any government restraints, acts of war and terrorism,
weather conditions, or for any misadventure or casualty or any other force
majeure or causes beyond their control. Subject to the terms and conditions Ferreolus’
liability shall be limited to up to the price paid for the booked
arrangements. Ferreolus does not own hotels or restaurants and has no
liability for loss or damage caused by the proprietors or operators thereof.
11. Passports and Visas
11.1 It is the
responsibility of all participants, regardless of their nationality, to
check with the appropriate authorities about any visa and immigration
requirements. We will not accept any responsibility if you or any passenger
travels without the correct passport, visa, health insurance or any other required
documentation.
12. Smoking
12.1 Smoking is only
permitted out doors in French hotels and restaurants. Bags for disposal of
cigarette butts can be provided on request.
13. Food and drink
14.1 For safety
reasons no hot food or drinks are to be carried onto our vehicles.
15. Hotel Reservations
15.1 The name and
contact information of the accommodation provider will be available on your Catharcountry
tour confirmation.
15.2 You
acknowledge that the availability of the facilities and features listed for
each hotel are under the direct control of the hotel and as such Ferreolus
cannot be held responsible if those facilities or features are not made
available to you during the period of your stay. If a facility or feature is of
particular importance to you, then you should check with Ferreolus or the hotel
that this facility or feature will be available during your dates of stay
before you make your reservation. Please note that, in particular, swimming
pools and air conditioning are only available seasonally and it is your
responsibility to check whether these facilities will be available during your
stay. You acknowledge that the inclusion in the hotel's facilities of car
parking, means that a provision is made by the hotel for car parking.
16. English Law
16.1 These
Conditions and the contract between us are subject to English law and the
exclusive jurisdiction of the English courts.
